These Terms of Service ("Terms") form a legal agreement between you and Oxelis Digital LLC, a Wyoming limited liability company ("we", "us", "our", "Arktan"), the operator of arktan.com. By accessing or using this website you agree to be bound by these Terms. If you do not agree, please do not use the site.

1. What Arktan Is

Directory and reviews. Arktan operates as a curated directory and review platform for AI-powered adult content creation tools. We list, describe, compare, and editorially review third-party tools and platforms. We are not the developer or operator of those tools.

Content publisher. Arktan also publishes original AI-generated adult imagery and video produced by our editorial team using the tools we review. All such content is created by Arktan staff; we do not accept user-generated uploads.

2. Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access or use this site. By using the site you represent and warrant that you meet this requirement. We reserve the right to terminate access for anyone we reasonably believe is underage.

3. Permitted Use

You may use this site for lawful, personal, non-commercial purposes. You agree not to:

Scrape, crawl, or systematically extract content without our prior written permission;

4. Affiliate Relationships & Commercial Disclosures

Some links on Arktan are affiliate links. When you click through and make a purchase or sign up on a third-party platform, we may earn a commission at no additional cost to you. Affiliate relationships never influence our editorial ratings or rankings. We clearly label affiliate links where required by the FTC Guides Concerning Use of Endorsements and Testimonials in Advertising.

5. Content Sourced From Partner Platforms

Certain tool listings may include sample output images or screenshots sourced from partner platforms. Such content remains the intellectual property of the respective platform or creator and is used under license or with permission. 6. Third-Party Tools & No Endorsement

Listing a tool on Arktan does not constitute an endorsement, guarantee, or warranty of that tool. We provide editorial opinions and factual descriptions to the best of our knowledge. You use third-party tools entirely at your own risk and subject to those tools' own terms and policies.

7. Intellectual Property

All original content on this site — including text, reviews, AI-generated images, page design, and branding — is owned by or licensed to Oxelis Digital LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent, except as permitted by fair use.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Oxelis Digital LLC, its members, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) this site;
Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

10. Indemnity

You agree to indemnify, defend, and hold harmless Oxelis Digital LLC and its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the site.

11. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

11.1 Agreement to Arbitrate

You and Oxelis Digital LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the site shall be resolved exclusively through final and binding individual arbitration rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

11.2 Pre-Arbitration Process

Before initiating arbitration, you must send a written notice of dispute to our contact address describing the claim and the specific relief sought. We will attempt to resolve the dispute informally within sixty (60) days. If no resolution is reached, either party may proceed to arbitration.

11.3 Arbitration Procedures

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator in the English language. The seat of arbitration shall be Sheridan, Wyoming, USA, unless otherwise agreed. The arbitrator may award the same remedies available in court but only to the extent required to satisfy the individual claim.

11.4 Class Action Waiver

YOU AND OXELIS DIGITAL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

11.5 Costs

Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules. If the arbitrator finds that either the substance of your claim or the relief sought is frivolous or brought for an improper purpose, the arbitrator may reallocate fees.

11.6 Opt-Out

You have the right to opt out of this arbitration agreement by sending written notice of your decision within thirty (30) days of first accepting these Terms to our contact address. If you opt out, neither party is bound by this arbitration provision, but all other provisions of these Terms remain in effect.

12. Expiration of Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the site must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

13. California Residents

If you are a California resident, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. To the extent litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming.

15. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Material changes will be indicated by updating the "Last Modified" date at the top and, where practicable, providing notice on the site. Your continued use of the site after a revision constitutes acceptance of the revised Terms.
